Marijuana Dispensaries

Permitted Zones and Applicable Municipal Code
Marijuana dispensaries are permitted within Retail Commercial (C-1) and Downtown District (D-D) Zones per Waldport's Municipal Code Chapter 16.28.B and 16.30.010.A. Retail stores or shops, such as food store, drug store...  are uses permitted outright.  Other uses may be reviewed by contacting Planning or the City Manager.
 
Marijuana dispensaries are not permitted in any other Zone districts within the City without a Conditional Use application.
 
Procedure
An application for a marijuana dispensary is submitted to the Oregon Liquor Control Commission (OLCC).  On request the City will complete a Land Use Compatibility Statement outlining approved use within specified zones and forward the completed / signed form to the OLCC. There presently is no fee for the LUCS.
 
State Regulations
Marijuana dispensaries are required to follow all State of Oregon regulations. 
 
Taxes Imposed and Means of Collection
As described in Section 34a of House Bill 3400 (2015), the City of Waldport imposes a tax of three percent on the retail sale price of marijuana items by a marijuana retailer in the area subject to the jurisdiction of the City.  
 
Taxes are collected at the point of sale of a marijuana item by a marijuana retailer at the time of the sale, and remitted by each marijuana retailer. Ord. 760, 2016
